There may not be a copyright infringement, but what about trademark?
Does Linux International and/or Linux Australia have the word "Linux"
and the Ewing penguin trademarked, and if not why not?  This certainly
seems to be the sort of thing that might lead to dilution of the Linux
brand in the public eye.
