Mick,

Larry Ewing gave everyone the right to use the image of Tux as long as they
acknowledged him and the GIMP as the creators.  It does not make any difference why
you are using Tux, or for what product, even lotteries.

The second artist, however, the one that made the "winter scenes" that the lottery
used, does have a copyright on those images.  If the Lottery used those images
without that person's permission, then they are in violation of that artists'
copyright whether or not Larry gave them his permission on the basic "TUX" penguin
design.

If the lottery hired the artist to create the winter scenes and that artist happened
to use Tux as a model, that is o.k. as long as they gave credit to Larry and the
GIMP.  On the other hand, there are many, many copies of Tux out there that are
not appropriately attributed.
