On the downside, the current EU presidency (Luxemburg) wants to push it
through anyway. It'd get lots of opposition in the EuroParliament during
the 2nd reading of course, and considering the situation it's all rather
arrogant. But heck, some big businesses have been busy lobbying for
this, so some poor little politions feel compelled to go aye.

To sum it up, the fight is not quite over yet.
But the antis are still in good shape.
