You can sue anyone for anything regardless of whether you'll win or not. For
example, I could sue you for giving me the cold I had last year but it would
hardly stand up. In fact, a judge might throw it out and award you damages
for my being so stupid.

The question we need to ask, though is:

 "Would it be worth the law firm suing the company who contracted them?"

It depends on a case by case basis. It depends on the exact wording of the
contract and so forth.

The answer--in my humble opinion--is "yes" but the real question is: "Is it
worth it?"
