     ma·li·cious -  given to, marked by, or arising from malice


     mal·ice - 1  : desire to cause pain, injury, or distress to another
		2  : intent to commit an unlawful act or cause harm without legal 
justification or excuse

Note that malice requires a desire or intent.  This implies that the 
party involved is performing a deliberate act based on premeditation.
The marking of a site as 'dangerous' by an automated algorithm 
(correctly or incorrectly) can not be considered a premeditated 
deliberate act as there was no desire or intent to harm unlawfully.
This is similar to how murder and manslaughter are often different due 
to the thoughts behind it.

What google did may be considered in-advised, incorrect, a complete 
failure in process or just plain stupidity, but it can not be considered 
a malicious act.
